TERMS OF SERVICE

IMPORTANT: Clients must be at least 18 years old to purchase a commission, due to the adult nature of some of my work, and due to the risk of chargebacks. I check profiles of clients before accepting commissions to make sure they are of age. Also, under NO circumstances may someone try to purchase a mature or adult rated commission on behalf of a minor. I understand this all may not seem fair but I must protect my business first and foremost. Thanks for reading.

1) Displayed base prices are subject to change according to the complexity, difficulty, size and medium of each individual piece.

2) Clear and concise visual references and/or description of a commission idea must be provided by the Client. After which a preliminary quote will be provided by the Artist.

3) Payments may be made up front or after the sketch stage is approved. The Client may choose the preferred option*. Payment must be completed in full before any finished artwork is received. 

4) If the artwork is finished before final payments are made, the Client will not receive the digital image of the commission until final payments are made.

5) Clients will have the opportunity to ask for changes of their commission in the rough sketch stage.  I will present an initial rough sketch from which the client may request any revisions to before I refine the drawing.  No more than three sketch re-draws will be made unless the Client wishes to pay extra for new sketches. 
No free edits to the artwork will be made post-colouring stage unless it is due to Artist error. Any further alterations/additions to the image will incur a fee.

6a) If the Client has paid up front and wishes to cancel their commission before any work has been started, they will be given a full refund. (However, I strongly recommend to be sure you can commit to a commission before applying for a slot, please don't waste my time!)

6b)  If the Client wishes to cancel their commission during the sketch/ink stage they will be refunded 50% of what they paid.

7) If the Client wishes to cancel their commission during or after the colouring stage they will not be issued a refund.

8) On completion, the Client will receive two versions of the image; the original resolution for private use and a resized one for web use. The Client may upload the smaller image only, and may not remove the Artist's watermark from either image.

9) Under no circumstances may anyone other than the commissioner of an image upload said image to their own FA gallery. Groups and individuals on sites such as Tumblr, e621, Facebook etc may share the image if linked credit is given. Characters belong to their respective players and should not be used without permission.

10) The Artist will not discuss a commission with a client via public forum. Clients must ensure emails are written in clear English to ensure no miscommunication of details. 
Any details missed due to Client error, poor quality reference images or miscommunication are not the fault of the Artist. (TL;DR I am not a mind reader.)

11) The Artist reserves the right to refuse a commission, or issue a refund and cancel a commission due to poor communication, rude or inappropriate behaviour, inability to communicate in effective English, or if the client is found to be a minor. 

12) The Artist ensures the Client will receive email/note updates on commission when necessary. Clients are encouraged to check in when they feel it's necessary for updates, assurance or reminders. Public updates will be made regularly via https://trello.com/b/SigLm7Er/taz-commission-queue


13) The Artist will not handle depiction of any subject considered by the artist to contain one of the following themes. Subjects the artist will not draw includes but is not limited to: underage characters/cub; non-consensual sex; nsfw ferals or human/anthro x feral; torture, bodily harm or death; hard gore (mild ok), extreme inflation (mild ok), hard vore (suggestive ok); bodily functions and waste (ws ok); hate speech, racist stereotypes; fetishised transgender/intersex characters etc. No slogans, hateful flags/uniforms etc. if subject is not listed here but you are unsure, please ask before submitting a request. The artist may refuse a commission based on any content they are uncomfortable with.

14) The Artist will not accept commissions involving copyrighted characters. Exceptions may be made on a case-by-case basis regarding stylized anthro versions of Pokemon, Digimon, and fan characters etc.

15) The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the commissioned work is a time-sensitive gift the Artist may delay public showcase at the request of the Client.

16) The Artist retains ALL the rights to the commissioned artwork, including the right to make prints and merchandise. Image rights can be negotiated for an added fee. (The artist will ask the character owner before creating printed artwork, fyi!)
 
17) The Client retains all rights to their respective characters.  This does not allow them rights to the commissioned image (see articles 15 and 16).

18) The Client may not profit from the artwork beyond the resale of a physical original painting or drawing (traditional media, not digital). This includes the sale of the digital files, or rights to the image.
 
19) The Client may create prints for personal use (display in their home or as gifts).  Client may also resize or crop the artwork to create icons, wallpapers, or other graphics** to be used in non-commercial digital format, but the Client cannot alter the artwork itself. The Client may also upload the artwork to their personal website or gallery, but credit is required, and it must be the resized version of the artwork only.

20) The Artist may recycle sketches and concept works that were rejected by the Commissioner for other commissions or personal works.

21) The Client must read, understand and agree to all the above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the above terms.
*If the artist is doing a limited slot offer via journal or twitter, payment up front is highly preferred.**The artist is quite happy to provide altered artwork of a commission for use as icons or wallpaper, just ask!

22) The Client may not use any commissioned artwork to generate derivative works using AI/ML software, or to create NFTs. Doing so will ensure they are blacklisted from future commission opportunities.
